TERMS OF SERVICE

Please Note: This section is very long. But it is still required to read through, both for your awareness of policy and for my safety as an artist.DISCLAIMER + GENERAL
- By commissioning me, you automatically agree to my TOS. Failure to follow it can result in me refusing/cancelling your commission.
- Using my art, commission or not, for AI, NFT, or any alike purpose is STRICTLY forbidden.
- I reserve the right to add users who violate these rules to a blacklist.
- This list may be added onto/changed as time goes on.
- You may NOT repost my work without permission. If that permission is given, you must visibly and clearly credit me. This also goes if you wish to use my art in a video/project.
- You may use my art for personal use such as icons, wallpaper, etc. But you must credit back to me (if shown on a public site).
- You may print/create a physical copy of my work as long as it's for personal use only (not for sale) and you do not take the credit.
- You are NOT authorized to change/modify/edit my works without permission.
- You are NOT authorized to trace/heavily reference my art and claim it as your own (this does not include private style studies and the like).
- Any harassment of any kind will not be tolerated.
- Clients who have commissioned/received work before this TOS has gone into effect are still bound to its contents.
- You are free to ask any questions or for clarification related to my TOS.ARTIST
- By commissioning me, you are purchasing my service as an artist only.
- I reserve the right to post, or not post, your commission for any reason.
- I reserve the right to decline any project/client for any reason.
- I reserve the right to refund you the full amount paid if I no longer wish to work on your project.COMMERCIAL USAGE
- If you wish to order a commission for commercial use (thumbnail for a monetized video, etc.) , everything will have to be discussed and agreed upon upfront.
- Any project that is for commercial use will have a price increase based of the method. This will also be discussed beforehand.COPYRIGHT
- I reserve the right to sign/watermark my work, paid for or not.
- I retain all copyright over my work, which includes redistributing/reproducing/using the image as a sample unless otherwise agreed upon.
- In the case of a commission, I will not claim the rights of a character that's not mine. It will not be used for commercial use unless agreed upon.PRIVACY REQUEST
- If you wish for your commission to be private, please state during the ordering process.
- The privacy request entails that I'm not allowed to share any wips on social media. However, this means you must do the same (this does not apply to sharing it in tight knit discord servers).ORDERING COMMISSIONS
- When contacted, I will give you a template to fill out for request. You are expected to at least vaguely fill it out.
- Any addition fees due to complexity, etc. will be stated before the transaction, and you hold the right to make changes to your request before the transaction is complete.PAYMENT
- For the time being, I only accept payment through Ko-Fi. I will NOT accept crypto or checks.
- Do NOT send me any payment until I have confirmed I can accept your request and have confirmed the amount.
- I either take full payment up front, or take half upfront and half after the initial sketch as been approved.
- If payment has not been made in 72 hours (3 days) after I've confirmed the amount, and no delays have been discussed, the commission will be cancelled. If there are any delays, please contact me promptly.
- Repeated counts of commissioning a project and failing to pay may result in blacklisting.
- Nothing is ever intended to be shipped to the client unless explicitly discussed.REFUNDS
- 100% of the payment will only be refunded during the ordering or initial sketch stage. Once the final/cleaner sketching starts, only partial refunds will be given/negotiated on.
- If for any reason, something goes wrong with the payment, please contact me promptly to resolve the issue.QUEUE/SPEED/DEADLINES
- I usually take up to 5-7 days to respond, depending on my life at the moment.
- If you want a deadline for your commission, it MUST be disclosed upfront and during the ordering process.
- I have the right to decline a deadline if I feel that the time is too short.
- I may take anywhere from 2 weeks to a couple months to work on and finish a commission. This depends on the queue and life factors.
- No harassment over my work speed will be tolerated.
- I can not guarantee that I will work on commissions in order. The current project may change depending on what I am most inspired/comfortable with at the moment.
- If there are any major delays to my work, you will be notified.REVISIONS/FEEDBACK
- Unless otherwise agreed upon, I will send wips for each stage of work.
- Each time I send a wip, I expect to be provided feedback.
- You have responsibility to ensure your order contains the details you want me to follow.
- I am not responsible for any unsatisfactory element if no feedback is given to amend it.
- Up to 3 major revisions can be made during the sketching stage. After that, any big changes will be met with a fee and only minor adjustments within reason can be requested afterwards.
- Major changes will only be made at the sketch stage. Up to 5 minor changes are allowed during the lineart stage. Color corrections can be made at the coloring stage.
- Any change to the character or subject may be subject to a fee, depending on the change.
- I am not responsible for any changes in ownership of said character(s).
- After the order is complete, 3 minor changes such as color adjustments are allowed. This does NOT count if the missing/inaccurate elements are something I overlooked; these can be done at request.
- After those last 3 changes, any more will be subject to a fee.
- I will not redraw a completed work unless payment is received for a second order.FINAL PRODUCT
- There may be differences between the samples in my gallery and the commission as my style is fluid. The client must respect this and I have the right to reject critiques pertaining to artistic skill.
- Credit to me, as the artist, is required when you post or use my work.
- Any file or data I give/you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 6 months, but I can not guarantee against computer failure, accidental deletion, or loss.
- If your commission is posted, I am not required to keep it up indefinitely, even if it was paid for as you should have a personal copy.
- Feedback of the final piece is expected through messages or comments. Any comments that are rude/inappropriate/inflammatory may result in blacklisting.
